1. (1) The length of time a licensee or registered provider has to make corrections will be determined by the department, which must consider:

   1. (a) the scope and severity of non-compliance;
   2. (b) the potential threat or actual harm to the health, safety, and well-being of the children in care;
   3. (c) the number of times the licensee or registration holder has not complied with rules in this chapter or under Title 52, chapter 2, part 7, MCA; and
   4. (d) mitigating and aggravating factors.
