(1) The beneficiary of a self-sufficiency trust must be:
- (a) a resident of the state of Montana;
- (b) a person with a disability; and
- (c) potentially eligible for services provided by the department or for mental health services provided by the department of corrections.
- (2) A person of 18 or more years of age has a disability only if the person is unable to engage in any substantial gainful activity due to the disability.
(3) Services provided by the department include:
- (a) developmental disabilities services;
- (b) vocational rehabilitation services;
- (c) independent living services;
- (d) severe disabilities services;
- (e) weatherization services;
- (f) low income energy assistance;
- (g) aid for dependent children;
- (h) food stamps; and
- (i) medicaid services.
