1. (1) The beneficiary of a self-sufficiency trust must be:

   1. (a) a resident of the state of Montana;
   2. (b) a person with a disability; and
   3. (c) potentially eligible for services provided by the department or for mental health services provided by the department of corrections.
2. (2) A person of 18 or more years of age has a disability only if the person is unable to engage in any substantial gainful activity due to the disability.

3. (3) Services provided by the department include:

   1. (a) developmental disabilities services;
   2. (b) vocational rehabilitation services;
   3. (c) independent living services;
   4. (d) severe disabilities services;
   5. (e) weatherization services;
   6. (f) low income energy assistance;
   7. (g) aid for dependent children;
   8. (h) food stamps; and
   9. (i) medicaid services.
