1. (1) An EDC must identify an individual or individuals to constitute its governing body. The governing body must:

   1. (a) exercise general policy, budget, and operating direction over the EDC; and
   2. (b) appoint an administrator of the EDC.

2. (2) The administrator appointed by the governing body must:

   1. (a) have the minimum qualifications for hire as determined by the governing body;
   2. (b) maintain daily overall management responsibility for the operation of the EDC; and
   3. (c) develop and oversee the implementation of policies and procedures pertaining to the operation and services of the EDC.
3. (3) The administrator may also serve as the medical director or clinical director if the administrator meets the qualifications of the respective position.
