1. (1) The facility must identify an individual or individuals to constitute the governing body of the facility. The governing body must:

   1. (a) exercise general policy, budget, and operating direction over the facility; and
   2. (b) appoint the administrator of the facility.

2. (2) The administrator appointed by the governing body shall, at a minimum:

   1. (a) hold a current Montana nursing home administrator license;
   2. (b) be a licensed health care professional; or
   3. (c) have equivalent credentials approved by the department.
