1. (1) If at any time it is discovered that an emergency or an immediate hazard condition exists, the owner or his representative shall:

   1. (a) immediately take remedial measures, notify the local sheriff, and notify the department of the emergency action or repairs or breaching to be instituted by the owner; and
   2. (b) for dams being operated under an operation permit, the owner shall immediately implement the emergency action plan.
