1. (1) The department will notify all involved parties of a wage claim or complaint.

2. (2) Employers must respond and provide any requested information by the date specified in the notice.

   1. (a) If requested prior to the response deadline, the department may grant additional response time for good cause shown.
   2. (b) Failure to timely respond may result in a decision adverse to the employer.
3. (3) If a response alleges the wage claimant is an independent contractor, the working relationship will be analyzed.
4. (4) If a complaining party fails to provide requested information to the department within specified time frames, the department may dismiss the complaint.
