1. (1) Factors considered when determining whether "good cause" exists for extending the one-year time limit for filing a claim, or for extending the 72 hour deadline to report criminally injurious conduct to law enforcement after its occurrence include, but are not limited to the following:

   1. (a) age of the victim when the crime occurred;
   2. (b) whether the delay in filing or reporting was reasonable, considering the circumstances of the crime and the resulting injuries to the victim;
   3. (c) physical or mental incapacity; or,
   4. (d) failure of law enforcement or prosecutors to notify the victim about the crime victim compensation.
2. (2) There is no good cause to extend the time limit if the claim is filed more than two years after the latest date the claim could have been filed in accordance with 53-9-125 , MCA.
