1. (1) In order to comply with 32-1-242, MCA, the applicant must submit:

   1. (a) the purpose of the proposed bank;
   2. (b) the proposed location of the initial principal place of business;
   3. (c) the class or classes of stock proposed to be issued, the proposed offering price per share, and the aggregate dollar amount of the proposed initial paid-in capital and justification for the amount of initial paid-in capital;
   4. (d) the proposed name of the institution;
   5. (e) the names and resumes of the proposed senior officers and the initial directors, at least three of whom must also be among the incorporators;
   6. (f) the residential addresses and occupations of the proposed incorporators and directors;
   7. (g) the proposed articles of incorporation and bylaws of the institution;
   8. (h) the number of shares of voting stock proposed to be subscribed for by the incorporators and each of the proposed directors and senior officers, and the names and resumes of any other persons who are expected to subscribe for, to own or to control more than 10 percent of the voting stock and the amount of stock for which each proposes to subscribe;
   9. (i) evidence of the character, financial responsibility, and ability of the incorporators, directors, senior officers, and owners;
   10. (j) evidence, in the form of a business plan and such additional information as the department may require, demonstrating that the proposed banking institution is likely to be financially successful;
   11. (k) the proposed policies of the banking institution;
   12. (l) a statement as to whether the banking institution is to be a Montana commercial bank, a savings bank, a trust company, or an investment company and, if the proposed Montana commercial bank or savings bank is applying for trust powers, a statement to that effect; and
   13. (m) any other information that the department may require.
2. (2) The department may request additional information from an applicant if, in its discretion, additional information is needed to reach a decision on the application.
