The following definition applies to rules within this subchapter:

1. (1) “Depository bank” means a bank as defined in:

   1. (a) 32-1-105, MCA;
   2. (b) 32-1-106, MCA;
   3. (c) 32-1-107, MCA, if the bank engages in one or more of the purposes set forth in 32-1-107(1), (7), or (9), MCA; or
   4. (d) 32-1-108, MCA.
