1. (1) A member may at any time before retirement request that his or her public employees' retirement service credits earned prior to their latest TRS membership service be transferred in accordance with the provisions of 19-20-409 , MCA provided that the member:

   1. (a) is an active contributing member of the teachers' retirement system; and
   2. (b) is not eligible for membership under the public employees' retirement system.
2. (2) In no instance shall a member be able to qualify more service into the teachers' retirement system than they had in the public employees' retirement system.
3. (3) No more than 1 year's creditable service shall be awarded for service during the same fiscal year.
