1. (1) The department shall prepare an intended use plan (IUP) annually.
2. (2) A project selected for funding is subject to denial by the department of natural resources and conservation based on its review for financial capability, as required under 75-5-1113, MCA.

3. (3) The following factors must be considered in developing the IUP:

   1. (a) ability of each listed project to proceed within the fiscal year;
   2. (b) each project's position on the project priority list;
   3. (c) long-term health and viability of the revolving fund, and the ability of the revolving fund to support the project; and
   4. (d) financial need of the project applicant.
