1. (1) The department will offer to sell eggs from its brood stock only when the following conditions are met:

   1. (a) the department owns eggs that are surplus to its needs; and
   2. (b) eggs certified to be disease free under the procedures of ARM 12.7.501 are not available from private sources within the state.
