1. (1) The department may waive the requirement to obtain a special recreation permit for a competitive event or organized group activity if the event or activity:

   1. (a) is not commercial;
   2. (b) does not award cash prizes;
   3. (c) is not publicly advertised;
   4. (d) poses no appreciable risk for damage to lands owned or managed by the department or related water resource values;
   5. (e) requires no specific management or monitoring;
   6. (f) is consistent with the recreation management guidelines in the department's Blackfoot River Recreation Management Direction; and
   7. (g) poses no appreciable risk to public health and safety.

2. (2) The department may waive the requirement to obtain a special recreation permit for commercial use, a competitive event or organized group activity if the use, event or activity:

   1. (a) is conducted by an individual or entity owning land adjacent to the Blackfoot River that is managed by the department; and
   2. (b) occurs entirely on the land owned by the individual or entity and managed by the department.
