1. (1) The following exceptions apply to the restrictions placed on waters in subchapters 5 through 62:

   1. (a) official patrol;
   2. (b) search and rescue operations;
   3. (c) maintenance of hydroelectric projects with prior notification by the utility;
   4. (d) scientific studies, including sampling fish populations, by department personnel;
   5. (e) for other than department personnel, scientific purposes with the director's prior written approval and any required permits; and
   6. (f) special events such as testing of motorized water craft with the director's prior written approval.
2. (2) The rules within this chapter generally do not require approval by the Department of Public Health and Human Services (DPHHS) under 87-1-303 , MCA, as they do not apply to issues of public health and sanitation. If a rule is adopted which does require DPHHS approval in regard to health and sanitation, the rule will indicate approval.
