UNDERGROUND FACILITIES DAMAGE PREVENTION BOARD

7.1This rule governs the form and content of requests for declaratory opinions, and the 7.2Any person with a substantial interest in the matter may request a declaratory 7.3The Board will issue a declaratory opinion regarding the applicability to specified 7.4The Board may, for good cause, refuse to issue a declaratory opinion 7.5Each request must be printed or typewritten, or legibly handwritten 7.6All requests must be mailed, delivered, or transmitted via facsimile to the Board 7.7Each request must include the full name, telephone number, and, mailing address of 7.8Each request shall contain the following:7.9Within forty-five (45) days after the receipt of a request for a declaratory opinion 7.10The forty-five (45) day period shall begin on the first State of Mississippi business 7.11A declaratory opinion shall not become final until the expiration of sixty (60) days 7.12The Board may give notice to any person, agency, or entity that a declaratory 7.13Declaratory opinions and requests for declaratory opinions shall be available for 7.14Any declaratory opinion rendered by the Board shall be binding only on the Board
