1. 1. For purposes of sections 306.111 to 306.119*, the term "operate" means to physically control the movement of a vessel in motion under mechanical or sail power in water.
2. 2. No arrest shall be made under sections 306.111 to 306.119* unless probable cause exists for that arrest.
