As used in this section and section 37.014:

1. (1) "Commission" refers to the Missouri minority business advocacy commission established under section 37.014;
2. (2) "Contract" means any contract awarded by a state agency for construction projects or the procurement of goods or services, including professional services;

3. (3) "Minority business enterprise" or "minority business" means an individual, partnership, corporation, or joint venture of any kind that is owned and controlled by one or more persons who are:

   1. (a) United States citizens; and
   2. (b) Members of a racial minority group;

4. (4) "Owned and controlled" means having:

   1. (a) Ownership of at least fifty-one percent of the enterprise, including corporate stock of a corporation;
   2. (b) Control over the management and day-to-day operations of the business; and
   3. (c) An interest in the capital, assets, and profits and losses of the business proportionate to the percentage of ownership;

5. (5) "Racial minority group" means:

   1. (a) Blacks;
   2. (b) American Indians;
   3. (c) Hispanics;
   4. (d) Asian Americans; and
   5. (e) Other similar racial minority groups;
6. (6) "State agency" refers to an authority, board, branch, commission, committee, department, division, or other instrumentality of the executive branch of state government.
