PURPOSE: This rule establishes prohibitions against certain activities and/or compensation being exchanged between commission members and employees and persons who are or may become a party to a covered transaction with the commission.

1. (1) In order to ensure that all persons meet a standard of responsibility which assures the Missouri Housing Development Commission (commission) and the state and its citizens that such persons will both compete and perform honestly in their dealings with the commission and avoid conflicts of interest, all persons shall comply with the commission’s Standards of Conduct Policy. To the extent a violation of the commission’s Standards of Conduct Policy calls for suspension or debarment procedures as it pertains to any person, the provisions of 4 CSR 170-8.140 shall be modified in the following manner:

   1. (A) All references to the commission subcommittee in subsections 4 CSR 170-8.140 (1)(A)–(1)(E) shall be replaced with commission; and
   2. (B) Any appeal of an initial determination by the commission action under provisions of subsections 4 CSR 170-8.140(1)(A)–(1)(E) shall be appealed to a court of competent jurisdiction in Jackson County, Missouri.
