PURPOSE: This rule establishes certain general provisions and operating permit program requirements for affected sources and affected units under the federal Acid Rain Program. PUBLISHER’S NOTE: The secretary of state has determined that the publication of the entire text of the material which is incorporated by reference as a portion of this rule would be unduly cumbersome or expensive. This material as incorporated by reference in this rule shall be maintained by the agency at its headquarters and shall be made available to the public for inspection and copying at no more than the actual cost of reproduction. This note applies only to the reference material. The entire text of the rule is printed here. (1) Applicability. This rule applies to the sources and affected units subject to the federal Acid Rain Program described under 40 CFR 72.6 as specified in section (3) of this rule.

1. (2) Definitions. Definitions of terms that apply to the Acid Rain Program may be found in 40 CFR 72.2 and 40 CFR 76.2 as specified in section (3) of this rule.

2. (3) General Provisions.

   1. (A) The provisions under 40 CFR 72, 40 CFR 73, 40 CFR 75, 40 CFR 76, 40 CFR 77, and 40 CFR 78, promulgated as of July 1, 2019 shall apply and are hereby incorporated by reference in this rule, as published by the Office of the Federal Register.    1. (B) If the provisions or requirements of 40 CFR 72 and 40 CFR 75 conflict with or are not included in Missouri state rule 10 CSR 10-6.065 Operating Permits Required, the provisions and requirements of 40 CFR 72 and 40 CFR 75 take precedence.
4. (4) Reporting and Record Keeping. Reporting and record keeping requirements are specified in the federal regulations incorporated by reference under section (3) of this rule.
5. (5) Test Methods. Test methods are specified in the federal regulations incorporated by reference under section (3) of this rule.
