1. (1) A request for a declaratory ruling by the department as to the applicability to a state of facts of a statute, rule, or order administered or issued by the department shall be submitted in writing to the director. The request shall contain all of the following information:

   1. (a) The scope and purpose of the request.
   2. (b) The statute, rule, or order administered by the department to which the request applies.
   3. (c) Signature and mailing address of the requestor.
2. (2) Within 30 days after receipt of a correctly filed request, the department shall notify the requestor by certified mail whether a declaratory ruling will be issued and, if it is to be issued, the nature and details thereof.
3. (3) Each request for a declaratory ruling regarding the same or different statute, rule, or order shall be submitted separately.
4. (4) The department shall provide notice of a declaratory ruling upon written request.
5. (5) If a request is denied, the department shall issue a concise written statement of its principal reasons for denial which shall be sent by certified mail to the requestor.
6. (6) The department shall make a declaratory ruling available to the public upon written request.
