As used in this chapter, unless the context otherwise indicates, the following terms have the following meanings.

1. 1. Crime "Crime" means a criminal offense in which, as defined, there is a victim.

2. 2. Victim "Victim" means:

   1. A. A person who is the victim of a crime; and

   2. B. The immediate family of a victim of a crime if: As used in this paragraph, "immediate family" means the spouse, domestic partner, parent, child, sibling, stepchild or stepparent of the victim.

      1. (1) The underlying crime is one of domestic violence or sexual assault or one in which the family suffered serious physical trauma or serious financial loss; or
      2. (2) Due to death, age, physical or mental disease, disorder or defect, the victim is unable to participate as allowed under this chapter.

      As used in this paragraph, "immediate family" means the spouse, domestic partner, parent, child, sibling, stepchild or stepparent of the victim.
