1. 1. Checking baitfish traps While trapping for baitfish in the inland waters with the use of a baitfish trap as defined in section 10001, subsection 7 from April 2nd to October 31st, a person shall check the baitfish trap or cause the baitfish trap to be checked at least once in every 7 calendar days. While trapping for baitfish in the inland waters with the use of a baitfish trap from November 1st to April 1st, a person shall check the baitfish trap or cause the baitfish trap to be checked at least once in every 21 calendar days.

2. 2. Penalty The following penalties apply to violations of this section.

   1. A. A person who violates subsection 1 commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.

   2. B. A person who violates subsection 1 after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.
