A. The following persons and entities are exempt from paying fees:
- (1) Government agencies;
- (2) Farmers whose principal residence is located on their farm;
- (3) Charitable organizations as defined under Business Regulation Article, §6-101(d), Annotated Code of Maryland;
- (4) Petroleum retail facilities, including marinas, with storage capacities of less than 75,000 gallons of gasoline and less than 100,000 gallons of diesel or similar fuel;
- (5) Any entity that is exempt under the federal Act; and
- (6) Any owner/operator of a facility that does not exceed the federal reporting thresholds for any EHS or hazardous chemical but voluntarily submits a Tier Two emergency and hazardous chemical inventory report to the SERC or the LEPC with jurisdiction over that facility, or both.
- B. The Secretary may exempt additional entities from payment of reporting fees.
