The provisions of this chapter, which are in addition to the requirements of COMAR 26.21.01, apply to permit applications for surface mines that:

1. A. Are located in karst terrane, as defined in Environment Article, §15-813, Annotated Code of Maryland, within Baltimore, Carroll, Frederick, and Washington counties; and
2. B. Require a water appropriation permit under Environment Article, §5-502, Annotated Code of Maryland.
