- A. If any part of the affected land is to be used as a landfill during mining or upon completion of mining, the Department may suspend the reclamation requirements for the area.
- B. The permittee shall obtain the prior written approval of the Maryland Department of the Environment and any other appropriate State, county, or local agency before engaging in landfilling activities.
- C. The permittee shall provide a time schedule to the Department for the orderly and timely completion of the landfill.
- D. Lands used for a landfill shall continue under performance bond for the benefit of the Department until the land is approved by the Department for release.
- E. The performance bond may be released if the Maryland Department of the Environment or other appropriate regulating agency approves a performance bond that is equal to or greater than the amount of bond held by the Department and if the bond provides that the mined area will be adequately reclaimed.
