- A. The permittee shall use overburden, mine waste, and rock to reduce the slope gradient of highwalls unless the permittee demonstrates that this use is impractical.
- B. The permittee shall stabilize storage piles of overburden, mine waste, and rock in accordance with the approved mining and reclamation plan and may not restrict any natural drainage without an approved diversion.
- C. The Department may require mine waste piles to be graded, covered with overburden or topsoil, and vegetated.
