A. Permits Required. Unless excepted under the provisions of §B of this regulation, a person:
- (1) May not operate a natural wood waste recycling facility in the State after July 1, 1992, without a permit issued by the Department under these regulations; and
(2) Shall operate the facility:
- (a) Under the conditions of an individual permit issued by the Department; or
(b) In accordance with the conditions of the general permit after the responsible party has:
- (i) Submitted a Notice of Intent (NOI) in accordance with Regulation .11 of this chapter, and
- (ii) Received a letter of acknowledgment from the Department.
- B. Exception. A permit issued under these regulations is not required for a natural wood waste recycling facility when the operator is required to obtain a permit under Environment Article, §9-204, Annotated Code of Maryland.
