1. A. Modification. The Department may modify any existing authorization if the modification is needed to reflect changes in State or federal statutes or regulations applicable to a scrap tire facility or hauler. This modification shall also be incorporated into a facility closure plan or emergency preparedness manual, and other documents as appropriate.

2. B. Transfer.

   1. (1) An existing authorization may be transferred to new owners if the conditions in §B(2) and (3) of this regulation are met.
   2. (2) Before any change in hauling company or facility ownership, a written request for transfer is submitted to and accepted by the Department. The request for transfer shall indicate the reason for the requested transfer, and shall be signed by those holding the authorization and those seeking to obtain it through transfer. The request shall also contain all information required in Regulations .05, .08, .12, .14, and .15 of this chapter, as applicable.
   3. (3) An existing authorization may be transferred to new owners if the Department finds that the proposed transfer of the authorization would not affect present or future compliance with these regulations.
