Substitute Fuel/Tire Derived Fuel Facility Approval Requirements.

A. Application Requirements. A person who wishes to use scrap tires as a substitute fuel in a resource recovery facility or in a facility that uses tires as a tire-derived fuel shall submit an application for approval to the Department. The application shall include the following information:
- (1) The information required by Regulations .08B and .12 of this chapter; and
(2) The following additional information:
- (a) The rate at which the scrap tires will be incinerated;
- (b) Identification of the applicable State and federal air quality standards;
- (c) A plan for closing the facility in compliance with Regulations .18—.20 of this chapter;
- (d) Financial assurance as required by Regulation .21 of this chapter for facilities participating in the scrap tire recycling system;
- (e) For facilities participating in the scrap tire recycling system, a financial statement completed by a certified public accountant that describes the applicant's assets and liabilities to provide evidence of the financial ability to properly establish, operate, and maintain a substitute fuel facility or tire-derived fuel facility.
- B. Conditions. Approved facilities shall comply with the requirements specified in Regulation .10B of this chapter.
