General Standards — Primary Scrap Tire Collection Facilities/Scrap Tire Recyclers.

- A. Location of Facility. A primary scrap tire collection facility or a scrap tire recycler may not be constructed or operated in a wetland, sinkhole, shoreland, ravine, 100-year floodplain, or any area where it may be subjected to immersion in water, unless authorized by the Department and the Department of Natural Resources.
B. Operation. A primary scrap tire collection facility or a scrap tire recycler shall operate in compliance with the following standards:
- (1) A routine operation involving the use of open flames, blowtorches, or highly flammable substances may not be conducted within 50 feet of a scrap tire pile;
- (2) All-weather approach and access roads to the facility shall be maintained passable for any vehicle at all times;
- (3) Access to the facility shall be strictly controlled at all times through the use of fences, gates, or other means of controlling entry;
- (4) The facility shall be under the supervision of a responsible individual present at all times that the facility is operating;
- (5) A sign shall be posted at the entrance of the facility stating the days and hours of operation;
- (6) If required by the Department, the facility shall be screened from public view by natural or artificial screening; and
- (7) The facility shall operate in compliance with any other operational requirement specified in the facility's license.
