An applicant is eligible to apply for financial assistance for one or more projects if the following conditions are fulfilled:

1. A. The applicant shall be a county or an incorporated municipality in Maryland;

2. B. The applicant shall submit evidence which demonstrates that the project will:

   1. (1) Provide pollutant reduction benefits for the stormwater which it handles,
   2. (2) Handle stormwater generated primarily from existing residential, commercial, industrial, or institutional use.
