1. A. An applicant may apply for a grant under the Act as set forth in this regulation.

2. B. The applicant shall:

   1. (1) Apply to the Department for a grant from the Fund before photography on the film production activity occurs;
   2. (2) If applicable, be in good standing in the jurisdiction in which it is organized and in the State;
   3. (3) Be the expected qualified film production employer; and
   4. (4) Expect to begin filming of the qualified film production activity within a reasonable period of time, not to exceed 120 days after the date of submission of the application.
