1. A. The Secretary:

   1. (1) Shall consider the petition;
   2. (2) May require argument on the petition; and
   3. (3) May issue the declaratory ruling requested or deny the petition.
2. B. A declaratory ruling is binding upon the agency and the petitioner, to the extent permitted by law, on the facts alleged.

3. C. Any declaratory ruling issued shall:

   1. (1) Be in writing; and
   2. (2) State the reasons for the decision.
4. D. A copy of the declaratory ruling shall be delivered to the petitioner.
