The Board of Public Works may waive or vary particular provisions of this title to the extent that the waiver or variance is not inconsistent with State statutes if:

1. A. In the Board of Public Works' determination, the application of a regulation in a specific case or in an emergency situation would be inequitable or contrary to the purposes of State law; and
2. B. The Office of the Attorney General approves the waiver for form and legal sufficiency.
