1. A. Fees shall be assessed according to the requirements in §§B—I of this regulation.

2. B. Persons Issued a Nursery Inspection Certificate or a Plant Dealer License.

   1. (1) For field inspections of:

      1. (a) 1 acre or less— $20;
      2. (b) More than 1 acre to 5 acres—$30;
      3. (c) More than 5 acres to 10 acres—$40;
      4. (d) More than 10 acres—$5 for each acre or part of any acre, up to a maximum of $1,500.
   2. (2) Nursery Inspection Certificate—$150 a year for each sales location.
   3. (3) Plant Dealer License—$150 a year for each sales location.
3. C. Persons issued a Plant Broker License. Plant Broker License—$150 a year.

4. D. Certified Seed Potatoes.

   1. (1) Production.

      1. (a) Field Inspection—$4 an acre or part thereof a year.
      2. (b) Bin Inspection—2 cents for each 100 pounds.
   2. (2) Imported Seed for Planting. Boxcar or Warehouse Inspection—8 cents for each 100 pounds.
   3. (3) Fees are due upon receipt of an invoice from the Department.

5. E. Trueness to Name Plant Certification.

   1. (1) Fees—$50 per acre or part of an acre in plant production.
   2. (2) Fees are due upon receipt of an invoice from the Department.

6. F. Virus-Free Plant Certification.

   1. (1) Certification Fee. Each plant producer shall pay the Secretary the following certification fee for each acre, or part of an acre, in plant production:

      1. (a) Strawberry plants—$50;
      2. (b) Grapevines, fruit trees, and bramble plants—$70.
   2. (2) Fees are due upon receipt of an invoice from the Department.

7. G. Miscellaneous Service Fees.

   1. (1) Soil sample analysis:

      1. (a) pH—$10;
      2. (b) Fertility—$10;
      3. (c) Pathogen—$25;
      4. (d) Nematode—$25.

   2. (2) Pest identification:

      1. (a) Routine—$5;
      2. (b) Nonroutine—$15;
      3. (c) Urgent—$25.

   3. (3) Equipment fumigation:

      1. (a) Equipment pick up—$25;
      2. (b) Equipment return—$25;
      3. (c) Hive body/deep super—$4;
      4. (d) Shallow super—$3.50;
      5. (e) Miscellaneous equipment—$1.50.

   4. (4) Phytosanitary certificates:

      1. (a) Including travel—$25;
      2. (b) Excluding travel—$5.

8. H. Other Miscellaneous Fees—up to $25 for each:

   1. (1) Publication;
   2. (2) Inspection;
   3. (3) Analysis; or
   4. (4) Sample.
9. I. A federal, State, or local public agency is exempt from the license and inspection fees required by this regulation.
