1. A. An applicant shall be determined eligible for enrollment through the Individual Exchange in a catastrophic plan if the applicant has met the requirements for eligibility for enrollment in a QHP through the Individual Exchange under Regulation .05 of this chapter and either:

   1. (1) Is younger than 30 years old before the beginning of the plan year; or

   2. (2) Has a certification in effect for any plan year that the applicant is exempt from the requirement to maintain minimum essential coverage set forth in §5000A of the Internal Revenue Code by reason of:

      1. (a) Section 5000A(e)(1) of the Internal Revenue Code, regarding individuals without affordable coverage; or
      2. (b) Section 5000A(e)(5) of the Internal Revenue Code, regarding individuals with hardships.
2. B. The certification described in §A(2) of this regulation may be provided by the U.S. Department of Health and Human Services or the Individual Exchange.
3. C. Changes in enrollment in a catastrophic plan under this regulation are effective based on the effective dates under Regulation .08I of this chapter.
4. D. Eligibility under this regulation is contingent upon verification of the applicant’s attestation that the applicant meets the criteria stated in this regulation.
