1. A. The Secretary or the Commission, as appropriate, shall serve written notice of the hearing on the parties.

2. B. The hearing notice shall contain:

   1. (1) The date, time, place, and nature of the hearing;
   2. (2) The legal authority and jurisdiction under which the hearing is to be held, including citation to any statute or regulation that is pertinent;
   3. (3) The nature and subject matter of the hearing;
   4. (4) A statement of the right to present witnesses and documents;
   5. (5) A statement that a copy of the hearing procedures is available upon request;
   6. (6) A statement of any right or restrictions pertaining to representation;
   7. (7) The name, mailing address, and telephone number of each party to whom the notice is sent;
   8. (8) The name, title, address, and telephone number of any attorney or Commission employee who has been designated to represent the agency at the hearing;
   9. (9) A statement that failure to appear for the scheduled hearing may result in an adverse action against that party; and
   10. (10) A statement that parties may agree to the evidence and may waive their right to appear at the hearing.
