1. A. The PSTEB shall make the final determination in each appeal from rulings of the licensure staff.

2. B. Before making a final determination, the PSTEB shall provide each member with:

   1. (1) A copy of the ruling of the licensure staff which is the subject of the appeal;
   2. (2) The written request for appeal;
   3. (3) The written report of the Review Board;
   4. (4) Any documents in the file cited in the report; and
   5. (5) Any written exceptions and response to exceptions.
3. C. The Department shall make the entire appeal file available to the PSTEB members on request.
4. D. The PSTEB shall, by majority vote of the quorum present, accept or reject the recommendation of the Review Board. The decision of the PSTEB is final.
5. E. The chairperson of the PSTEB shall notify the appellant in writing of the final determination, including the rationale for it.
