1. A. Student Records.

   1. (1) A school shall have on file the previous student record of each student enrolled who was previously enrolled in a public or nonpublic school.
   2. (2) Before enrolling a student, a school shall review the student record maintained by the school the student attended most recently to assist in determining the appropriate program placement or grade placement, or both, within the educational program.
   3. (3) If the previous student record of a student is not available before enrollment, a school shall document, within 5 school days of placement, at least two attempts to acquire the previous school record of each student.

   4. (4) A school shall maintain student record information on a standard form for each student, which includes all of the following:

      1. (a) School's name;
      2. (b) School's location address;
      3. (c) School's telephone number;
      4. (d) Student's first, middle, and last names;
      5. (e) Month, day, and year of student's birth;
      6. (f) Student's home address;
      7. (g) Month, day, and year student initially entered; and
      8. (h) Month, day, and year student withdrew.

   5. (5) A school shall maintain student record information in a standard format for each student, which includes all of the following:

      1. (a) Student's specific days of attendance;
      2. (b) Student's performance information based on the student's IEP, or grades in each curricular area, or both, as applicable;
      3. (c) Code for the meaning of the performance information, or grades, or both, as applicable;
      4. (d) Student's PEP or IEP, or both, as applicable; and
      5. (e) Student's grade placement.
   6. (6) A school shall give a copy of the complete student record of each student as specified in §A(4) and (5) of this regulation to the representative of the placing agency of each student upon discharge from the school.

2. B. Personal Education Plan (PEP).

   1. (1) A PEP shall be developed for each student who is enrolled in an educational program that is not a full-day or residential special education program.

   2. (2) The PEP shall include all of the following:

      1. (a) Student's first, middle, and last names;
      2. (b) Student's gender;
      3. (c) Month, day, and year of student's birth;
      4. (d) Projected beginning month, day, and year and ending month and year for implementation of PEP;
      5. (e) Grade level of student's performance in reading and mathematics;
      6. (f) Standardized tests or diagnostic tests, or both, used to determine grade level of a student's performance in reading and mathematics and month, day, and year of administration;
      7. (g) Educational program or programs in which a student is enrolled as specified in Regulation .09A of this chapter;
      8. (h) Schedule of student's classes and teachers;
      9. (i) Specific secondary school credits earned, if applicable;
      10. (j) Summary of Maryland test requirements determined by the State that have been met, and those that have not been met, as applicable;
      11. (k) Transition plan to prepare a student for specific further education or training, or employment, or independent living, or any combination of these;
      12. (l) Month, day, and year of PEP development;
      13. (m) Signature of individual who prepared the PEP; and
      14. (n) IEP of student, if applicable.
   3. (3) The current PEP and IEP, as applicable, of each student shall be available in the classroom or classrooms of each student.
