1. A. In this chapter, the following terms have the meanings indicated.

2. B. Terms Defined.

   1. (1) “Actively teaching” means an individual is:

      1. (a) Employed full-time;
      2. (b) Not employed as a substitute;
      3. (c) Not on extended leave; and
      4. (d) Teaching for at least 30 percent of the work week.
   2. (2) “Candidate” means a teacher actively teaching in Maryland and certified in Maryland who has met the nomination requirements to stand for election to a seat on the State Board of Education.
   3. (3) “Certificate” means an educator credential issued by the Department, which allows the holder to practice the area or areas of certification noted.
   4. (4) “Department” means the Maryland State Department of Education.

   5. (5) “Immediate family member” means a:

      1. (a) Parent;
      2. (b) Sibling;
      3. (c) Child by blood, adoption, or marriage;
      4. (d) Spouse;
      5. (e) Grandparent; or
      6. (f) Grandchild.
   6. (6) “Teacher member-elect” means the teacher candidate who received the highest number of votes from certified teachers in the State in an election conducted by the Department.

   7. (7) “Vacancy” means a teacher member:

      1. (a) Has resigned as the “teacher member” on the State Board of Education, or the teacher member’s designated term has ended;
      2. (b) Has been removed from office;
      3. (c) Is no longer certified to teach in the State; or
      4. (d) Is no longer actively teaching in the State.
