1. A. A court may, at sentencing, order the Commissioner to refer an individual to Patuxent Institution for evaluation, unless ineligible under Regulation .06 of this chapter, if the individual is:

   1. (1) Younger than 21 years old at the time of the referral; and
   2. (2) Sentenced to a term of imprisonment of 3 years or more for a criminal offense.

2. B. The Commissioner shall:

   1. (1) Maintain a list of individuals who have been referred by court order to the Institution for evaluation as participants in the Program; and
   2. (2) Submit the list monthly to the Director.
