A training authority may submit an application to the Commission for certification of an individual as an Electronic Control Device Instructor if the individual seeking certification:

1. A. Is a Commission-certified police officer who:

   1. (1) Is authorized by the police officer’s employing agency to carry or use the specific manufacturer’s model of an electronic control device for which the individual, if granted certification, would provide instruction; and
   2. (2) Has successfully completed a Commission-approved Academic Instructor training program that meets requirements under Regulation .07 of this chapter.

2. B. Is not a Commission-certified police officer, but has:

   1. (1) Successfully completed a Commission-approved training course for the specific manufacturer’s model of an electronic control device for which the individual, if authorized, would provide instruction; and
   2. (2) Been determined by the Deputy Director to be qualified to provide electronic control device instruction based on the individual’s knowledge, skills, and abilities with the specific manufacturer’s model of electronic control device for which the individual, if authorized, would provide instruction.
