1. A. If an individual applies for reinstatement under Transportation Article, §16-208(b)(2), Annotated Code of Maryland, the Administration may waive the:

   1. (1) Driving test; and
   2. (2) Knowledge of the law test.

2. B. In determining whether to waive the tests under §A of this regulation, the Administrator shall consider whether:

   1. (1) The reason for the revocation would require that one or more tests, as appropriate, be administered;
   2. (2) The driving record of the applicant would require that one or more tests, as appropriate, be administered;
   3. (3) Some other reason, discovered during the reinstatement process, would require that one or more tests, as appropriate, be administered; and
   4. (4) A waiver would be contrary to public safety.

3. C. If an individual applies for reinstatement under Transportation Article, §16-208(b)(3), (4), or (5), Annotated Code of Maryland, the Administration may not reinstate the individual until the individual:

   1. (1) Passes the driving test, vision screening, and knowledge of the law test; and
   2. (2) Complies with any other conditions imposed by the Administration as a prerequisite to being reinstated.
