1. A. If the physical or mental condition of an individual indicates there is a likelihood of substantial and immediate danger and harm to the individual or others if the individual's license is continued pending evaluation by the Medical Advisory Board, then the individual's driving privileges shall be suspended pursuant to the provisions of Transportation Article, §16-206, Annotated Code of Maryland. The physical or mental condition may come to the attention of the Administration when:

   1. (1) A physician's certificate is received by the Medical Advisory Board;
   2. (2) The individual is referred to the Medical Advisory Board for any reason;
   3. (3) The Administration receives information that a licensee has violated a restriction, limitation, or other requirement imposed as a prerequisite for issuance or reinstatement of a license; or
   4. (4) When the Administration becomes aware of a serious medical condition in any other manner.

2. B. The individual shall be notified in writing of the suspension either:

   1. (1) By personal delivery to the individual; or
   2. (2) By mail to the individual at the last address of record with the Administration.

3. C. The notice under §B of this regulation shall:

   1. (1) Describe the mental or physical conditions supporting the emergency suspension; and
   2. (2) Inform the individual of the right to inspect and copy all medical records and other documents considered in the emergency suspension, except records and documents designated confidential by their source, under Regulation .07 of this chapter.
