1. A. In determining whether to impose an administrative fine on a licensee for any violation under Transportation Article, Title 15, Annotated Code of Maryland, the Administration shall consider:

   1. (1) The seriousness of the violation;
   2. (2) The deleterious effect of the violation on others;
   3. (3) Any acts of good faith on the part of the licensee;
   4. (4) The licensee's history of previous violations; and
   5. (5) Previous counseling or reprimands on the issues under consideration;

2. B. Failure to submit title and registration data, fees, and taxes may result in a standard fine which is assessed at a rate of:

   1. (1) For a tag and title service that submits transaction information later than required by the contract between the tag and title service and the Administration, the standard fine shall be:

      1. (a) For the first late day after the requirement to submit by contract, $30; and
      2. (b) Increased by $1 per day thereafter.

   2. (2) For a dealership that submits transaction information later than 30 days after the transaction date, the standard fine shall be:

      1. (a) For the first day after 30 days, $30; and
      2. (b) Increased by $1 per day thereafter.
3. C. Fines levied in §B of this regulation are the standard fines and can be adjusted as determined by the Administration based on circumstance. Nothing in this section limits additional administrative action as determined by the Administration including license suspension and revocation. .
