1. A. In this chapter, the following terms have the meanings indicated.

2. B. Terms Defined.

   1. (1) “Asynchronous” means not occurring in real time.
   2. (2) “Board” means the Maryland Board of Massage Therapy Examiners.

   3. (3) Health Care Services.

      1. (a) “Health care services” means to provide client instruction through telehealth using:

         1. (i) Techniques that include, but are not limited to, stretching, movement, breathing, and self-massage; and
         2. (ii) Applications, such as nonlegend topicals and hot and cold packs or pads.

      2. (b) “Health care services” does not include:

         1. (i) Mental health counseling; or
         2. (ii) Nutritional counseling.
   4. (4) “In-person” means within the physical presence of the client.
   5. (5) “Synchronous” means occurring in real time.
   6. (6) “Telehealth” has the meaning stated in Health Occupations Article, §1-1001, Annotated Code of Maryland.
   7. (7) “Telehealth practitioner” means a Maryland licensed massage therapist or a registered massage practitioner performing telehealth services within their respective scope of practice as defined under Health Occupations Article, §6-101, Annotated Code of Maryland.
