1. A. In this chapter, the following terms have the meanings indicated.

2. B. Material and Egregious Violation

   1. (1) “Material violation” means any course of conduct, including a single incident, that may cause a program, individual, or organization to fail to comply with any statutory, regulatory, or contractual requirement.

   2. (2) “Material and egregious violation” includes but is not limited to:

      1. (a) Fraudulent or other behavior which influences or may influence the payment or receipt of money or other property;
      2. (b) Practices which affect or may affect the health or safety of any individual; or
      3. (c) Practices which violate or may violate participant rights.
