1. A. Subject to the provisions of this section, the Board may impose the following sanctions and penalties for violations of the Maryland Licensed Dietitian-Nutritionists Act and its regulations according to the minimum and maximum sanctions and penalties set forth as follows:

   (1) Continuing education	Reprimand	Active suspension for 1 year and $1,000 fine
   (2) Criminal convictions or pleads nolo contendre	Reprimand	Revocation and $5,000 fine
   (3) Noncompliance with previous Board order	Reprimand	Active suspension for 2 years and $5,000 fine
   (4) Fails to meet accepted standards of practice	Reprimand	Revocation and $5,000 fine
   (5) Impairment (mentally, physically, or through the use of drugs or alcohol)	Probation	Denial of a license application or revocation and $5,000 fine
   (6) Fraud	Reprimand	Denial of a license application or revocation and $5,000 fine
   (7) Reciprocal discipline	Reprimand	Denial of a license application or revocation and $5,000 fine
   (8) Sexual misconduct	Active suspension for 1 year	Revocation and $5,000 fine
   (9) Unprofessional conduct in the practice of dietetics	Reprimand	Revocation and $5,000 fine
   (10) Aiding the unauthorized practice of dietetics	Reprimand	Active suspension for 1 year and $1,000 fine
   (11) Performing the unauthorized practice of dietetics	$0	$5,000 fine

2. B. If a licensee is found in violation of more than one category enumerated in this chapter, the ranges with the maximum sanction and the range with the maximum penalty associated with those categories shall be applied.
