1. A. Except as otherwise provided in this regulation, to qualify for a permit, the facility and the applicant shall pass an evaluation of facility equipment, medications, and clinical records to include at least the following:

   1. (1) Oxygen and gas delivery system, backup system fail-safe;
   2. (2) Gas storage facility;
   3. (3) Safety indexed gas system;
   4. (4) Suction and backup system;
   5. (5) Auxiliary lighting system;

   6. (6) Suitability of operating room:

      1. (a) Size;
      2. (b) Lighting;
      3. (c) Communications; and
      4. (d) EMT accessibility;
   7. (7) Recovery area, including oxygen, suction, and visual and electronic monitoring, which may include the operating room;
   8. (8) Appropriate emergency drugs;
   9. (9) Nonexpired drugs;
   10. (10) Appropriate devices to maintain an airway with positive pressure ventilation;
   11. (11) Preoperative medical history and physical evaluation form;
   12. (12) Anesthesia records, including monitoring and discharge records;
   13. (13) Monitoring equipment, including pulse oximeter and blood pressure monitoring;
   14. (14) Anesthesia and monitoring equipment to ensure they are in proper working order;
   15. (15) Defibrillator or automated external defibrillator (AED);

   16. (16) For deep sedation or general anesthesia in pediatric patients:

       1. (a) A precordial stethoscope;
       2. (b) A pretracheal stethoscope; or
       3. (c) A capnograph; and

   17. (17) For Class II and Class III permits:

       1. (a) An electrocardiogram (EKG);
       2. (b) A capnograph measuring device; and
       3. (c) Pulse oximeter.
2. B. In addition to the requirements outlined in §A of this regulation, to qualify for a permit, the dentist who will perform the administration and the dentist's staff shall be present in the operatory during the evaluation.
3. C. An applicant for a permit may not transport anesthesia or sedation equipment from one dental office to another for facility examination purposes.
