This chapter does not apply to an individual who:

1. A. Practices a health occupation, other than certified dialysis technician, that the individual is authorized to practice in accordance with Health Occupations Article, Annotated Code of Maryland;
2. B. Provides for the gratuitous care of friends, domestic partners, or family members;
3. C. Performs dialysis technician tasks as a student while under the direct supervision of qualified faculty;
4. D. Performs nursing tasks delegated by a registered nurse or licensed practical nurse so long as the delegated nursing tasks do not become a routine part of the unlicensed or uncertified individual’s job duties; and
5. E. Is an unlicensed caregiver hired by a cognitively capable adult to assist the individual at their home in treatments of a routine nature and in self-administration of medication.
